Condominium Ownership Procedure

If you hold a Tapu with Storey Easement Rights (Kat Irtifaki) specified, which is a tick in the middle box of the Tapu, the following is the procedure to obtain the left hand tick which is Kat Mulkiyeti, Condominium Rights. The local press are announcing that if you have not applied before November 09 you will face a fine of 1000 TL.

If you own a villa, this does NOT apply to you. Please check your current Tapu to see whether there are any tick boxes available. If there are no boxes, you need take no action. Typically this procedure is only required if you own in an apartment building, shared with others.

The first step is to apply to the Title Deeds and Kadastro (Land Registry) Office for change of type. The address is the ground floor of the Title Deeds Building.

Documents Required
1.Original and a photocopy of the Title Deed (Tapu)
2. Certificate of Occupancy for all the individual apartments (Iskan - permit of residency). If there is no Iskan, you must apply to the Council (Belediye) for this
3. Recent photocopy of Earthquake Insurance Certificate (DASK) for all the individual apartments
4. Photocopies of Identity Certificates or Passports of the individual apartment owners
5. Recent document from the Tax Office stating that there are no tax debts against your tax number
6. Property Value Document from the Council Estate (Emlak desk) service for all the individual apartments

If all of these documents are obtained, only one of the house owners needs to apply for the whole building to change the type. In this case, all the house owners do NOT need to go together.

If several of the individual apartments have certificate of occupancy, the owner of the individual apartment can apply individually at the Kadastro office and fill in a ready petition, which will exempt him/her from the fines. In this case, the change of type and condominium ownership will not take place.

Procedure for transferring to condominium ownership

Once the application for change of type is approved by the Kadastro office, Office of the Register of Deeds will change the title deed certificate and issue it to the owners.

For the transfer regarding condominium ownership, one of the house owners will apply to the Title Deeds Office with 2 passport photos and a photocopy of their identification certificate or passport to get their Condominium Ownership Title Deed - Kat Mulkiyeti.
